dc.description.abstractمن الواضح أن قوانين الذاكرة، التي كان هدفها الأولي في الغرب هو تعزيز ثقافة الذاكرة الديمقراطية التي تؤكد على معاناة الضحايا، أصبحت في مناطق أخرى من العالم، خاصة في شرق القارة، تعني التعبئة القومية وحروب الذاكرة. فهذا التطور يرجع بالطبع إلى خصائص الدول التي عرفت النظام الاشتراكي السوفييتي، ويبدو أن إساءة استخدام عناصر الذاكرة في كلا البلدين إلى حد كبير كان له كبير الأثر على تعزيز مشاعر العداء والجفاء بين الشعبين. لكن هذه التطورات مرتبطة أيضًا بمبدأ استخدام القانون الجنائي كأداة لتنظيم الذاكرة التاريخية. فالحقيقة كما يحدّدها القانون دائمًا ما تكون مختزلة للغاية بالمقارنة مع الحقيقة التاريخية، كما أنّ قوانين الذاكرة، كما هي عليه في روسيا وأوكرانيا، تمنح القوميين والشعبويين أداة مريحة للغاية للتلاعب بحقائق الماضي، مما يقلل الفرص لتحقيق فهم التاريخ المشترك بين الشعبين، بناءً على فحص نقدي يتجنّب توظيفه كرهان سلطوي is obvious that the memory laws, whose initial objective in the West was to promote a democratic culture of memory emphasizing the sufferings of the victims, ended up becoming, especially in the east of the continent, privileged means nationalist mobilization and wars of memory. This evolution is of course due to the particularities of the countries having known the Soviet socialist regime, and the abuse of non -tollit USum seems, to a certain extent, applicable here. But these developments are also linked to the very principle of the use of criminal law as an instrument for the regulation of historical memory. The truth of the law is always very reductive in comparison with historical truth, much more complex and nuanced. The memory laws give nationalists and populists an instrument that is too convenient to manipulate the facts of the past, which reduces our chances of achieving an understanding of history based on its critical examination
