| dc.description.abstract | إن الإشكالية التي تسعى هذه الورقة البحثية تنطلق من البحث في قدرة النص القانوني من عدمه في ضمان أدوار للمجتمع المدني الجزائري والتي من شأنها تفعيل السياسات العامة. أما فرضية الدراسة فهي تنطلق من تناقص دور النص القانوني مقارنة بالنموذج الثقافي الذي يعد معيقا لمشاركة فعالة في عملية صنع السياسات العامة. وسعيا منا للإجابة على هذه الإشكالية فإننا نعتمد على الاقتراب القانوني و كذا منهج التحليل الوثائقي و ذلك للنظر في محتوى النصوص القانونية التي من شأنها تفعيل أدوار المجتمع المدني، كما نعتمد على المنهج المقارن من خلال مقارنة زمنية للنصوص القانونية التي تنظم العمل الجمعوي و النقابات في الجزائر و بالاعتماد على المشاركة كوحدة مثالية للمقارنة بين الفترات الزمنية المختلفة. كلمات مفتاحية: الجزائر،المجتمع المدني، السياسات العامة،الإطار القانوني للجمعيات Objectives: This study seeks to examine whether or not the legal text can guarantee roles for Algerian civil society that would activate public policies. We assume through this study that the role of the legal text is diminished compared to the cultural model, which is disabled to effective participation in the policy-making process. Methodology: This study is conducted by using legal approach and documentary analysis to consider the content of legal texts that will make the roles of civil society more effective, as well as on the comparative approach by comparing the context of the legal texts managing civil society and associations work, and trade unions in Algeria and by relying on participation as an ideal unit for comparing different context. .Keywords: Algeria<civil society, public policy ,civil society legislation | |
